In this document we share the terms and conditions that govern your use of our website, services and content.

1. Introduction

These Terms and Conditions govern the professional services provided by Esben Studio ("we", "us", "our"), a creative and product studio based in Nantwich Cheshire, England. (CW5) By engaging our services you agree to these terms.

2. Services

All services are outlined in a proposal or written agreement before work begins. Any changes to agreed scope may result in additional charges and revised timelines. We require timely provision of content, feedback and approvals from clients to deliver on schedule. Delays caused by the client may affect agreed timelines.

3. Payments and Fees

All fees are agreed in writing before work starts.

Our standard payment structure is 50% deposit taken upfront, with the remaining 50% paid upon completion of the project.

Monthly retainers are invoiced on the first working day of each month. Payment terms are 14 days from the invoice date. We reserve the right to pause work on overdue invoices. Late payments beyond 30 days may incur statutory interest under the Late Payment of Commercial Debts (Interest) Act 1998.

4. Cancellations

If you cancel a project after work has begun you are liable for all work completed to that point. Deposits are non-refundable once work has started. Retainer agreements require 30 days written notice to cancel.

5. Intellectual Property

On receipt of full payment, ownership of agreed final deliverables transfers to you. All work in progress remains our property until payment is received. We retain the right to display completed work in our portfolio unless you request otherwise in writing.

6. Confidentiality

Both parties agree to keep confidential any sensitive business information shared during a project. This obligation continues after the project ends.

7. Limitiation of Liability

Our total liability for any claim shall not exceed the total fees paid for the specific project in question. We are not liable for indirect or consequential losses including loss of revenue or profits.

8. Photography, Video and Social Media

Where we produce photography or video featuring individuals, it is the client's responsibility to obtain appropriate consents. Raw files remain our property unless agreed otherwise. For social media management, you retain ownership of your accounts at all times. We remove access upon termination of the service within 7 working days.

9. Governing Law

These terms are governed by the laws of England and Wales.

10. Changes

We may update these terms periodically.
